Introductory provisions:

These General Terms and Conditions of Business (hereinafter referred to as “GTC”) regulate the contractual relations between the provider of accommodation services – Mountain Chalet Orlík (hereinafter referred to as “accommodation provider”) and the user of the services provided (hereinafter referred to as “client”).

Applicable law

The contractual relations between the parties shall be governed by the law of the Czech Republic.

Ordering and payment for services
Ordering and concluding an accommodation contract

Ordering a stay in the Horská chata Orlík facility can be done in writing by post at the address specified in Article 1 of the GTC, by e-mail specified in Article 1 of the GTC, by telephone at the telephone number specified in Article 1 of the GTC or via the form on the website www.chataorlik.cz, or via third parties regularly mediating the conclusion of an accommodation contract (booking.com, etc.). An order made in writing, by telephone or by e-mail will be confirmed by the accommodation provider to the client within 3 days by e-mail, in which he specifies the conditions of the provision of services, attaches to it these GTC and an invoice for payment of the advance payment. Upon payment of the invoice, the client agrees to the GTC and concludes the accommodation contract. An order made via a form on the accommodation provider’s website, where the client agrees to these GTC, is confirmed by the accommodation provider to the client within 3 days by e-mail; this confirmation of the order constitutes the conclusion of the accommodation contract. The conclusion of the accommodation contract on the basis of an order placed through third parties regularly arranging the conclusion of the accommodation contract is effected by the confirmation of the order by the intermediary, who informs the client of these GTC, unless the intermediary demonstrably chooses another way. In the case of payment of the advance payment by credit card through the payment gateway on the website of the accommodation provider in the situation specified in Article 4.3 of these GTC, the accommodation contract is concluded by making this payment. The Client agrees to the use of remote means of communication when concluding the accommodation contract. The costs incurred by the client in concluding the accommodation contract shall be borne by the client. The Client acknowledges that the Accommodation Provider is not obliged to conclude the Accommodation Contract even if it has a vacant accommodation capacity for the requested date, especially, but not exclusively, with persons who have previously materially breached the Accommodation Contract including the GTC.

Prices of services

The prices of services are determined by the accommodation provider, are published on the accommodation provider’s website www.chataorlik.cz in the Price List section and are always applied except in cases where the accommodation provider and the client agree on other prices for the services provided.Services that are not included in the Price List must be ordered explicitly and their price will be specified in the relevant agreement between the accommodation provider and the client.

Payment terms

Each binding reservation must be secured by a minimum of 50% of the price of the stay. The maturity and amount of the deposit will be determined by the accommodation provider in agreement with the client. For reservations made more than 5 days before arrival at Orlík Mountain Chalet, the accommodation provider will issue an invoice to the client, which the client will pay by bank transfer. For reservations made 0-5 days before arrival, the client pays the deposit by credit card through the payment gateway on the website of the accommodation provider www.chataorlik.cz or by invoice. If the client does not pay the invoice by the due date, the accommodation provider is not bound by the order and the accommodation contract is not concluded. The client shall pay the additional payment for the accommodation upon arrival at the Orlík Mountain Chalet. The payment of the accommodation supplement can be made in cash, by credit card or by meal vouchers, whose current acceptance must be verified with the staff of the Orlík Mountain Chalet. All credit card payments at Orlík Mountain Chalet are subject to a 2% transaction fee.

Parking

The Orlík mountain chalet is located on a steep slope and is accessible only by a forest and only partially paved road, the passage of which depends on the season and weather conditions. In winter, parking at the chalet and access to the chalet is not possible at all, in other seasons it is necessary to consult the staff of the Orlík Mountain Chalet for arrival and departure by car to the chalet. The possibility of parking in the vicinity of the Orlík Mountain Chalet depends not only on the weather conditions, but also on the occupancy of the chalet by other guests. In case it is not possible to park at the chalet, there is a public car park approximately 900 metres from the chalet. Clients can park in this car park at a discount of approximately 42% of the parking fee, i.e. for CZK 70,- after discount for one car per night. Clients can use the operators of the mountain taxi service, whose contact details will be provided to the client by the staff of the Orlík chalet upon request. It is advisable to contact the taxi service well in advance. The taxi service will transport clients to a distance of approximately 100 metres from the chalet, the last 100 metres to the chalet must be covered by an unmaintained forest path. Therefore, suitable mountain footwear is recommended, preferably the use of non-skid shoes in winter. Accommodation

Mountain chalet Orlík has eight double and three quadruple rooms. One extra bed can be added to each room, usually in the form of a sofa bed, armchair or futon. A double room has a size of 15 – 20 m2, a quadruple room 30 – 35 m2. The rooms are smaller, simply furnished, but for the needs of visitors to the mountains purposeful and cozy. Each room has a bathroom and a TV. A more detailed description of the rooms and photos can be found on the website of the accommodation provider www.chataorlik.cz. Accommodation starts, and all services agreed in the accommodation contract can be used, on the day of arrival from 15:00 and ends on the day of departure at 10:00. The client is obliged to vacate the room by 10:00 on the day of departure. Upon mutual agreement between the accommodation provider and the client, it is possible to agree on a different time of arrival and the start of the services and the time of the final vacating of the room.

Catering

Meals (breakfast and dinner) in the Orlík Mountain Chalet are buffet style. Breakfast consists of a hot and cold buffet and hot and cold drinks. Dinner is served as a starter, soup, main course, dessert, cheese and fruit. Breakfast is served from 08:00 to 10:00, dinner from 18:00 to 20:00. The bar is open from 8:00 to 22:00, the closing time can be postponed by mutual agreement between the host and the client. Meals are prepared without special dietary restrictions, requests for special dietary regimes must be reported in the order at least 3 days in advance. If the accommodation provider is unable to accommodate these requests and the client insists on the diet and withdraws from the accommodation contract, the cancellation conditions specified in Article 12 of the GTC apply.

All inclusive package

The All Inclusive Package can only be booked for a full room and for stays of two or more nights.

The all-inclusive package includes breakfast, a packed lunch prepared by the client from the breakfast buffet and a buffet dinner, as well as one hour of private spa and free drinks. Beverage consumption within the all-inclusive package is possible from 8:00 a.m. to 8:00 p.m. and includes all non-alcoholic hot and cold drinks, beer, wine up to CZK 250 per bottle and spirits up to CZK 70 per 0.04 l. In the case of ordering wine priced above CZK 250 per bottle or spirits priced above CZK 70 per 0.04 litre, the client is obliged to pay the difference by which the price of the drink exceeds the specified limit.

Discounts for children apply to the all-inclusive package.

Wellness

In the Orlík Mountain Chalet you can use wellness: private sauna, whirlpool for 5 people and a social relaxation room. The client is obliged to book the entrance to the wellness at least 3 hours in advance with the staff of the Orlík Mountain Chalet. The prices of wellness services are published on the website of the accommodation provider www.chataorlik.cz in the section Price list, in case of purchasing an all-inclusive package it includes one hour of private wellness. Upon agreement with the staff of Orlík Mountain Chalet, it is possible to order massage services provided by experienced external masseurs; however, these services must be ordered at least 1 day in advance. Yoga classes can be booked in the same way. Prices for massages and yoga courses are available on the property’s website www.chataorlik.cz

Client’s rights and obligations

The client has the right to be provided with additional information, the right to protection of personal data, the right to proper provision of the prescribed services, the right to be informed of changes in the scope of services, the right to withdraw from the accommodation contract under the terms and conditions agreed in these GTC and the right to arrange a replacement for himself.

The client is obliged to cooperate with the accommodation provider in providing the necessary data, to present the accommodation provider with documents, to notify the accommodation provider of his/her health problems, especially allergies, to pay for the damage caused and lost profit, not to restrict or endanger other accommodated clients and to follow the instructions of the staff of the Orlík Mountain Chalet.

The client is obliged to observe the prohibition of smoking in the entire premises of the Orlík Mountain Chalet and the prohibition of cooking their own food. It is forbidden to consume own beverages in the restaurant and wellness area of the Orlik Mountain Chalet.

Rights and obligations of the accommodation provider

The accommodation provider is obliged to provide the client with the agreed services in the scope corresponding to the standard of the mountain chalet and in the scope specified in these GTC, in particular in Articles 6 – 9 of the GTC. This does not apply in the event of extraordinary events arising independently of the accommodation provider’s will, such as windstorms, frost, accidents, power outages or other events that the accommodation provider could not foresee or prevent.

The accommodation provider has the right to withdraw from the accommodation contract with immediate effect and without the client’s right to a refund in cases where:

– the client endangers the safety, health, property of the accommodation provider or other guests, in particular if the client intentionally or negligently damages the property of the accommodation provider,

– the client seriously violates legal regulations or legitimate instructions of the Orlík Mountain Chalet staff,

– the client disturbs other guests of the Orlík Mountain Chalet, repeatedly disturbs the peace of other guests.

Withdrawal from the contract by the client

The client has the right to withdraw (without giving any reason) from the contract from the moment of conclusion of the accommodation contract until the day of the start of the accommodation, but is obliged to pay the accommodation provider the cancellation fees listed below from the total price of the stay:

– in case of cancellation more than 100 days before the agreed date of commencement of the stay – 5% of the price of the stay, but at least CZK 500;

– for cancellations between 14 and 100 days before the agreed start date – 50% of the price of the stay;

– cancellation less than 14 days before the agreed start date – 100% of the price of the stay.

The client is advised to withdraw from the contract using the sample withdrawal form sent to the e-mail or correspondence address of the accommodation provider specified in Article 1 of the GTC or provided by the staff of the Orlík Mountain Chalet.

In the event of cancellation before the start of the stay, the accommodation provider will refund the deposit less cancellation fees to the client within 14 days of the client’s written cancellation. Section 2330(1) of Act No. 89/2012 Coll., Civil Code, shall not apply.

The client is also entitled to withdraw from the contract for other statutory reasons, unless this is excluded by these GTC or the agreed accommodation contract.

Complaints

The accommodation provider is responsible for the proper and timely provision of the ordered and confirmed service. The client has the right to complain about any deficiencies in the services provided, including the right to have them removed, replaced, supplemented, or to have a new service provided or a reasonable discount on the agreed price of the services paid. The client is obliged to make the complaint without undue delay so that a remedy can be agreed, preferably on the spot. The client shall make the claim verbally or in writing – by e-mail, to which he/she shall attach a proof of the service provided and describe the deficiency in the service he/she is claiming. If the verbal complaint is not satisfied on the spot, the accommodation provider or the staff of the Orlík Mountain Chalet handling the complaint is obliged to draw up a complaint report with the client, in which the personal data of the client, the identification data of the accommodation provider, the information about who handles the complaint, the date of the complaint, the subject of the complaint and the request for the method of its settlement are stated; the report is signed by the client and the person handling the complaint and the client receives one copy of the report. The client shall provide all the assistance necessary for the settlement of the complaint, in particular he/she shall provide true and complete information, allow the accommodation provider access to the premises intended for accommodation in order to assess the validity of the complaint, etc. The client is entitled to demand free, proper and timely elimination of deficiencies, usually by replacing the defective room equipment. If it is not possible to remove technical defects in the client’s room and if it is not possible to offer the client other, alternative accommodation and these defects are of such a nature that they prevent the client from using the room properly, the client is entitled to an appropriate discount on the price of accommodation. The accommodation provider is obliged to make a decision on a duly submitted complaint immediately, in more complicated cases within 3 working days. This time does not include the time required for a professional assessment of the defect. The complaint must be settled within 30 days of the client’s complaint, unless a longer period is agreed upon. In the case of a justified complaint, the accommodation provider is obliged to arrange for the defect to be removed free of charge or to provide a reasonable discount on the accommodation price. Deficiencies in the catering services provided by the accommodation provider shall be complained by the client directly in the restaurant and immediately upon discovery of the deficiency to the accommodation provider or the serving staff.

Processing of personal data

The client expressly agrees that the accommodation provider is entitled to process and store all information and data provided by the client for the purpose of providing accommodation services (hereinafter referred to as “personal data”) in accordance with the relevant generally applicable legislation, in particular in accordance with Act No. 101/2000 Coll., on the protection of personal data and on the amendment of certain acts and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC. The accommodation provider is the controller of all personal data it processes. Personal data will not be transferred to any third party. The personal data is processed only for the purpose of the correct provision of the ordered service. The Client has the right to access his/her personal data, the right to rectification, erasure, the right to object to processing, the right to data portability and the right to withdraw consent to the processing of such data, electronically at the following e-mail address: [email protected].

Out-of-court settlement of consumer disputes

In the event that a consumer dispute arises between the accommodation provider and the client under the accommodation contract which cannot be resolved by mutual agreement, the client may submit a proposal for out-of-court settlement of such a dispute to the designated out-of-court consumer dispute resolution body, which is:

Final provisions

The provisions of the GTC are an integral part of the accommodation contract.

These General Terms and Conditions of Sale and Cancellation come into force and effect on 1.6.2019.

The Client confirms that he/she has been informed of the accommodation provider’s GTC, understands them, agrees with them and accepts them in full.
